In recent months, there have been powerful new laws and court rulings that should provide much needed help to business owners.

The deadline for court filing of Katrina claims is August 28, 2007. New laws have been enacted to protect insureds from a wrongful denial of coverage, including penalties that equal up to 150% of damages plus attorneys fees.

New Laws That Change the Tide in Your Favor

A Federal Judge ruled on November 27, 2006 that most flood or water exclusions do not apply to the levee breaches. You may now be entitled to the full limits of your business interruption policy. Furthermore, the Legislature has enacted a new law that may allow you 150% of your damages and attorneys fees as compensation and penalties for insurers who have acted in bad faith.

The firm of Gauthier, Houghtaling and Williams has distinguished itself in Katrina business litigation.
